On June 21, 2010, Texas Lawyer featured an article entitled, Supreme Court Nixes Common-Law Claims in Sexual Harassment Suits.  The article discussed Waffle House v. Williams.  Art Lambert, who is board certified in labor and employment law, was interviewed for the article.  According to Art, the opinion is good for employers because it will eliminate a common tactic used by plaintiffs who file sexual harassment cases -- filing common-law negligent supervision and retention claims to maximize a potential damage award in a discrimination suit.  He was quoted by Texas Lawyer as stating that the decisions "was good management's side" because negligence awards can be larger than the statutory ones.
