King, Krebs & Jurgens Successfully Defends U.S. Navy in Toxic Exposure Case January 17, 2012 The United States was sued for personal injuries sustained by a merchant mariner who suffered acute liver failure shortly after working aboard a Military Sealift Command vessel. The plaintiff-seaman, who required a liver transplant, claimed that his illness was triggered by the inhalation of fumes from paint he worked with while aboard the vessel. The United States moved to have plaintiff's causation experts (a toxicologist, liver transplant surgeon and hepatologist) barred from testifying on the grounds that their opinions did not meet the minimum threshold for admissibility under applicable federal law. The Court granted the United States' motions, finding that none of the experts was able to establish that the chemicals involved (paints widely used by the US Navy in the maintenance of its fleet) were capable of causing acute liver failure. Having stricken these witnesses, the Court went on to dismiss all of Plaintiff's claims, due to a lack of proof supporting his case.

Judge Blackburn Rules on Alabama's Immigration Law Daniel Burnick, October 6, 2011 U.S. District Court Judge Sharon Blackburn issued a 115 page order on September 28, 2011, addressing Alabama's Immigration Law. The Order upholds most of the Immigration Law, including the E-Verify portions of the law. Her order prohibits the State from: 1. Making it illegal for an unauthorized alien to seek work as an employee or independent contractor. 2. Arresting and charging people with assisting unauthorized aliens, including blocking the provision that makes it illegal to conceal, harbor, transport or encourage an illegal alien to stay in Alabama. 3. Arresting and charging landlords who rent to unauthorized aliens. 4. Prohibiting businesses to take a deduction for wages paid to unauthorized aliens.

Pemberton, one of the Virginia insurance attorneys in the firm’s risk management team, learned that her cousin’s young son, Wilson Frerichs, age 6, had been diagnosed with leukemia in March of 2009, she asked if there was anything she could do for the family or Wilson. Pemberton says that the family replied that Wilson longed to be a fireman and was a collector of firefighter gear. Pemberton pledged to see what Virginia firefighting items she could collect on Wilson’s behalf.
